1. Agreement and Scope
By ordering, accessing or using a Hostech Web Solutions service, the customer accepts these terms together with the Acceptable Use, Privacy and Refund policies. The person placing an order confirms that they are authorised to act for the account holder.
2. Account Information
Customers must provide accurate contact, billing and identity information and keep it current. Account credentials must be protected. Activity performed through an account is treated as authorised unless the customer promptly reports suspected compromise.
3. Lawful and Acceptable Use
Services may be used only for lawful purposes. Prohibited activity includes malware, phishing, credential theft, unlawful surveillance, copyright infringement, abusive automation, unauthorised access, denial-of-service activity, open proxies, spam and content that violates applicable law or third-party rights.
4. Shared and Reseller Resource Use
Shared and reseller services are intended for normal website and email workloads. Accounts may not be used primarily for file distribution, public download archives, cryptocurrency mining, continuous background processing or workloads that materially affect other customers. Hostech may request optimisation or migration to a more suitable service.
5. Email and Anti-Spam Rules
Unsolicited bulk email, purchased mailing lists, address harvesting and deceptive sender information are prohibited. Customers operating legitimate mailing lists must obtain consent, provide a working unsubscribe process and promptly handle complaints and bounces.
6. Billing, Renewals and Taxes
Invoices are due by the date shown in the client area. Recurring services may renew automatically where a payment method and authorisation are available. Prices, taxes, exchange rates and third-party licence charges may change on renewal after reasonable notice.
7. Suspension and Termination
Hostech may suspend a service for overdue invoices, security risk, abuse, excessive resource use, false account information or breach of these terms. Immediate action may be taken when necessary to protect customers, networks or the public. Suspension does not remove payment obligations already incurred.
8. Backups and Data Responsibility
Any backup feature is provided as an additional safeguard and is not a substitute for the customer’s own independent backups. Customers remain responsible for website files, databases, email and configuration data. Backup availability and retention can vary by service.
9. Security and Software Maintenance
Customers must keep applications, plugins, themes, passwords and custom code secure and updated. Hostech may isolate or disable compromised services. Remediation, malware removal or recovery work outside the purchased plan may be chargeable.
10. Domains and Third-Party Services
Domain registration and transfer are subject to registry, registrar and ICANN rules. Third-party licences, control panels, payment gateways and software are also governed by their providers’ terms. Availability of a name or product is not guaranteed until confirmed and paid.
11. Service Availability
Hostech aims to provide reliable service but does not guarantee uninterrupted operation. Planned maintenance, emergency work, internet routing issues, attacks, upstream failures and events outside reasonable control may affect availability.
12. Limitation of Liability
To the extent permitted by law, Hostech is not liable for indirect, incidental, special or consequential loss, including lost profit, business interruption or lost data. Any direct liability is limited to the amount paid for the affected service during the three months before the event giving rise to the claim.
13. Indemnity
The customer agrees to protect and reimburse Hostech against third-party claims, penalties and reasonable costs arising from the customer’s content, conduct, breach of these terms or infringement of another party’s rights.
14. Changes to Services and Terms
Hostech may update products, technical limits and these terms to address security, legal, operational or commercial requirements. Material changes will be published on the website or communicated through the client area. Continued use after the effective date constitutes acceptance.
15. Governing Law and Contact
These terms are governed by the applicable laws of Pakistan, subject to mandatory consumer protections. Questions or formal notices may be sent through the client area or to legal@hostech.pk. Customers should obtain independent legal advice before relying on this template for a particular business or jurisdiction.
